I Have A Question About Options At The End Of A Reverse Mortgage? My mother passed away last month. She had a reverse mortgage on her home. Unfortunately the reverse mortgage is now equal to or greater than the value of the home (this is due to the interest and fees accumulating each month and the condition of my mother’s home).
Neither my sister nor myself want the house. We do not want to sell it. What are our options and are there any financial responsibilities that we can be liable for? We have been told we can offer the reverse mortgage company a deed in lieu of foreclosure. I don’t know if that is good or bad, or what that entails. Would it be better just to “walk away” from the home and have it go just to foreclosure?
If anyone has experience with this, or if you are knowledgeable on the subject, I would appreciate your input. Thanks!
Very sorry about your mom. A lot of the answers to your questions are very local/State specific. And my answer presumes your mother had an FHA HECM, versus a private or jumbo reverse. FHA has very strict guidelines as to what a lender must do upon the death of a senior and the time frames for doing it.
Having said that, a Deed in Lieu of Foreclosure (DIL) is when the senior/heirs decide to just give full title/ownership of the home immediately to the lender and let them take charge of selling the house, instead of making the lender go through a 6-month plus foreclosure process (depending on local/State laws) wherein the house will eventually be sold at auction and the lender can formally take over title, so it can then prepare the property for sale. A DIL saves the lender a lot of time and money, if it can get clear title right away (depending on any other liens etc. against the home). The condition of the home may affect whether the lender can accept a DIL (FHA guidelines).
Generally, regardless of what type of loan it is, for the borrower (not the heirs specifically), a Short Sale is better than a DIL, and a DIL is better than a Foreclosure. Since the bwr is deceased, it really doesn’t matter about your mom’s credit score. And since a reverse mortgage is a non-recourse loan, you don’t have to worry about loan deficiency. As far as the heirs go, you are not personally liable for the reverse mortgage.
However, you may be liable, as heirs, for other debt your mother may have against the home (or otherwise), and if she has a sizable estate, and if it goes to Probate. This would depend on your local/State laws. Also, if you walked away and let the lender do a long drawn-out foreclosure, it is possible that the heirs may be liable for whatever happens to the home while it sits vacant during the 6-plus months until the lender can take over title legally. And then there may be tax consequences of inheriting versus selling it yourself, versus DIL or foreclosure. These have nothing to do with the loan per se (you are not liable for the loan), but how you transfer title may have consequences that you should discuss with a professional real estate-tax-estate attorney. I can only answer regarding the loan liability.
Your first bet, if you haven’t already, is to talk to the lender’s servicing department as to what options you have. They are the only ones who can tell you. Once you know your options, then get a referral for an experienced attorney who specializes in taxes/real estate, because they can tell you how each option will affect you personally (the lender can’t). At the same time, there is a lot of information available online, and I would suggest you go directly to the FHA HECM webpages to do your own due diligence. Lawyers aren’t cheap. Good luck.

Anyways is it illegal to make a webpage and give my business a random name like “the clothes shop” ? do i need to have a lisences to do this?
Not sure about instagram, but it’s perfectly legal to sell on Twitter and facebook. People do it all the time. As long as the clothes aren’t knockoffs, you’ll be fnie.
