Can I Sue Revlon? Their Lip Stain Destroyed My Face!? I am a healthy 23 year old woman, who has fantastic clear skin. I never get acne, and never have gotten acne. a pimple here and there is the worst I’ve seen. Until……
I recently purchased a lip stain by Revlon called “Just Bitten”. I used it for a few days without issue. after the third day i noticed small raised bumps with no redness around my mouth and chin, and also a slight dryness on my lips. After a few more days, my lips felt as if they were flaking off entirely and the bumps were worse. I also got pimples all over the mouth area. I stopped using it. After weeks of natural treatments, my skin has finally cleared up, but I am left with poc-marks, acne scars and redness. My once gorgeous face is now ruined. I feel completely horrible about it emotionally. I am used to being that fresh faced person that everyone asks “What do you do to make your skin so perfect??!!!” and now i feel so ugly.
can i sue Revlon for destroying my face? I have photos as CLEAR proof. I would like to sue them so I can pay for my face to be cosmetically fixed (maybe laser scar treatments or something along that line that works). Do I have a case? or is this a waste of my time and well-earned cash?
Fred: im sorry i sound vain. I am totally not a judgemental person of people who arent attractive. personality is key in a good person, not looks…I dont mean to sound vain…i am just being honest. i’m deeply hurt that i dont look the way im used to looking. i just cant afford to get laser treatments ..im a hairstylist, not a millionaire. are you sure i dont have a case? can you explain why i dont ? im looking for legal advice……please.
and if i was, in fact, to begin using it again, i COULD prove it because my skin would react the exact same way. is this enough to have a case?
And thank you all for your timely responses , you are a great help!
and i do have doctor records of it. my doctor advised me to stop using the product and that i may be allergic…

On the face of it you are able to sue anyone as long as you have a cause of action (legal reason to sue) and the financial resources to do so. Some questions:

      1. Did you do a skin test on an inconspicuous part of your body to check for sensitivities before you started using the product on your lips?

      2. Have you ever undergone medical tests for allergies or sensitivities to any of the components of the Revlon product?

      3. Why did you continue to use the product after you noticed negative changes on your lips after three days?

      4. Were any other new products introduced in your beauty/personal care routine at the same time as the Revlon product?

      5. Have you been able to find anyone else who has been harmed in the same way by this Revlon product as you were?

You should have satisfactory answers to these questions (to say the least) before you think of launching a lawsuit against Revlon for negligence or product liability.

In tort law it is stipulated that above all else we owe a duty of care to ourselves. This goes beyond the duty of care that anyone else, including a manufacturer, owes us. If we know or can see that something will harm us, we are expected to be reasonable people and do what is required to prevent injury to ourselves.

Questions 1, 2, 3 and 4 address the duty of care the law deems that you owed to yourself. Before using a new product like this one, a reasonable person would have done the skin test to find out about allergies or sensitivities. The reasonable person would also have discontinued using the product once an adverse reaction was observed.

Regarding question 4, you have to be able to prove that using the Revlon product represented the only change you had made in your beauty routine.

Regarding question 5, being able to produce another person or other people who suffered the same fate would support your claim. With a group of people who claimed to be harmed by the same product, a judge could be persuaded to grant permission for the group to launch a class action lawsuit.
